Abstract

The project assesses whether issuing an electronic equivalent to a printed euro banknote could be based on the current TFEU provisions, and whether such an electronic equivalent could benefit from legal tender status under the current TFEU provisions. The investigators adress these legal questions from a policy based, a constitutional and a historical point of view. The study resulted in three peer-rewiewed publications (“The e-Banknote as a ’Banknote’: A Monetary Law Interpreted” (Oxford Journal of Legal Studies), “Digital Euro and ECB powers” (Common Market Law Review) and “Digital Euro, Monetary Objects, and Price Stability: A Legal Analysis” (Journal of Financial Regulation).

Keywords CBDC, digital euro; TFEU, Eurosystem, European Central Bank (ECB); banknotes; cash, monetary objects, monetary objectives, monetary policy instruments
