Abstract |
Research Questions:Which transparency rules are embedded in Intellectual Property Law? Whichgoals do these transparency rules serve and are they succesful in doing so?Method:Legal interpretation; analysis of statutes and case law; conceptual workImportance and Goals:The project assesses the role of transparency rules in the well-established fieldof Intellectual Property Law.The goal of this research project ist to clarify whether and how transparency isinstrumental to IP Law’s goals and purposes. This is a valuable contribution initself, but also a stepping stone to evaluate the newly proposed (or enacted) EUrules for the digital economy1 that heavily draw on transparency considerations.Outline:This research project will look at a whole range of mechanisms in IntellectualProperty Law that try to implement more (market-) transparency.In a first step, the project will identify such mechanisms across the wholereange of Intellectual Property Rights2. In a second step, these mechanismswill be analysed with regards to their success in attaining IP specific goals,such as innovation, creation and the functioning of the market. |
