Abstract

The use of illegally evidence in criminal trials differs among jurisdictions. One question however is at the core of discussions in all states: In cases in which procedural rule is violated, does the search for truth or the protection of individual rights prevail in criminal proceedings? The 18th International Congress on Comparative Law will discuss this question on the meeting in Washington 2010. The project focuses on the German Report on the use of illegally gathered evidence in criminal trial.
