Abstract

The work shop is part of the project “General Principles of Transnational Criminal Law.The project’s overall goal is to establish general principles for transnational criminal law, which can be engaged to guide decision makers in the process of resolving conflicts of interests arising in instances of cross-border law enforcement. Such measures are increasingly necessary because a variety of criminal conduct features an extraterritorial element. Penal actions are consequently in many instances no longer confined to one state’s territory or sovereignty.

Although enhanced interaction between various criminal justice systems, both national and international,iscommon, neither the newly arising conflicts of interests between those seeking to prevent and repress crimeor the individuals alleged to have committed the offenses and the victims of crime have been identified, nor have general principles that could serve to solve the problembeenestablished.
